Terms & Conditions

Please take a moment to read the terms that apply when your child attends Clever Cloggs Nursery. If anything is unclear, just get in touch — we're always happy to talk it through.

1 · Introduction

About these terms

These terms and conditions form a contract between the parent or legal guardian ("you") and Clever Cloggs Nursery ("us", "we", "the nursery"). By signing your child's registration form and accepting a place, you agree to be bound by everything set out below.

We may update these terms from time to time. If we do, we'll let you know in writing and the latest version will always be available on this page.

2 · Registration & Securing a Place

How places are confirmed

  • 📝 A completed registration form and non-refundable registration fee are required to join the waiting list.
  • 💷 A deposit equal to one month's fees is required to confirm and hold your child's place. This is offset against your final invoice when your child leaves, provided full notice has been given.
  • 📅 Places are allocated based on availability, age group, and the order in which deposits are received.
  • 👶 A settling-in period is offered to every new child and is included as part of the agreed start date.
3 · Fees & Payment

How fees work

Fees are payable monthly in advance and are due by the 1st of each month. Invoices are issued in the last week of the preceding month.

  • 🏦 Payment is accepted by bank transfer, standing order, childcare vouchers, and Tax-Free Childcare.
  • 📆 Fees are charged for the agreed sessions whether or not your child attends — including bank holidays, illness, family holidays, and any other absences.
  • 📈 Fees are reviewed annually and any changes will be communicated in writing at least one month in advance.
  • ⚠️ Late payment may incur an administration charge, and persistent non-payment may result in the loss of your child's place.
4 · Government Funded Hours

Free entitlement

We accept government-funded hours for eligible children, including the 15-hour and 30-hour entitlements. Funding is applied across 38 weeks of the year (term-time) and stretched where applicable.

Additional charges may apply for meals, consumables, and optional activities not covered by the funding. A clear breakdown will be provided in your monthly invoice.

5 · Attendance & Sessions

Drop-off, collection & absences

  • 🕗 The nursery is open Monday to Friday, 08:00 – 18:00, excluding bank holidays and the period between Christmas and New Year.
  • 🚪 Children must be collected by 18:00. A late collection fee applies for any child collected after closing time.
  • 🪪 Only persons named on the registration form may collect your child. Please notify us in advance — with a password — if anyone else will collect on your behalf.
  • 📞 Please let us know by 09:30 if your child will not be attending due to illness or any other reason.
6 · Illness & Medication

Keeping everyone safe

We follow current Public Health England guidance on infection control. Children with a contagious illness, a temperature above 38°C, or symptoms of sickness or diarrhoea within the last 48 hours must remain at home.

Prescribed medication will be administered only with written parental consent and where the medicine is in its original, labelled packaging. Long-term medication plans should be discussed with the nursery manager in advance.

7 · Notice & Termination

Changes & leaving the nursery

  • 📅 One full calendar month's written notice is required to change sessions, reduce days, or end your child's place. Notice must be received in the month prior to the change taking effect.
  • 💷 Where full notice is given, your deposit will be applied to the final invoice. Without full notice, fees remain payable in lieu.
  • 🤝 The nursery reserves the right to end the contract in cases of persistent non-payment, repeated breach of these terms, or behaviour that puts the safety of children or staff at risk.
8 · Safeguarding

Our duty of care

The welfare of every child is our highest priority. All staff are DBS-checked, trained in safeguarding, and follow our written Safeguarding and Child Protection Policy, which is available on request.

We have a statutory duty to report any concerns relating to the welfare of a child to the relevant authorities, in line with the Children Act 1989 and 2004.

9 · Data Protection & Privacy

How we handle your information

We process personal data in line with the UK GDPR and the Data Protection Act 2018. The information you provide is used only for the purposes of caring for your child, communicating with you, and meeting our legal obligations.

Photographs of your child are only taken and used with your written consent. For full details, please see our Privacy Policy.

10 · Liability

Belongings & insurance

The nursery holds full public liability insurance. While we take every care of personal belongings, we cannot accept responsibility for items lost, damaged, or soiled during your child's time with us. Please leave valuables at home and label all clothing and possessions clearly.

11 · Complaints & Feedback

If something isn't right

We're committed to providing the very best care, and we welcome your feedback. If you have a concern, please speak to your child's key person or the nursery manager in the first instance.

If a concern cannot be resolved internally, you have the right to contact Ofsted directly on 0300 123 1231.

12 · Governing Law

Jurisdiction

These terms are governed by the laws of England and Wales, and any disputes shall fall under the exclusive jurisdiction of its courts.
